Canada can cancel a valid visitor visa already stamped in your passport for various reasons that may justify such an action. Visitor Visa allows foreign nationals to visit family or friends or for business purposes, typically valid for 10 years or until your passport expires (whichever comes first). A visitor can stay for up to 6 months at a time, with the option to apply for an extension if there are valid reasons.

Canada remains a popular destination for travelers worldwide. However, recent reports indicate that the IRCC has been cancelling valid visitor visa for many foreign nationals. It is important to note that this is within the IRCC's authority. Holding a valid visitor visa does not guarantee entry into Canada every time you travel.

Various circumstances can lead to the cancellation of an existing visitor visa and you may even be denied entry at the port of entry if a CBSA officer finds a valid reason, such as the purpose of the visit. This applies even if you have previously entered Canada and returned to your home country.

Understanding the reasons behind visitor visa cancellations is crucial for maintaining compliance and ensuring a smooth travel experience.

Misrepresentation and Fraud

Misrepresentation involves providing false information or hiding relevant facts during the application process of the visa, leading to visa approval. If the IRCC later discovers this, they will immediately cancel the visa and impose a ban on entering Canada for up to 5 years.

Solution:

Be honest and accurate: Always provide truthful and precise information in your visa application. Double-checked all documents for accuracy.

Submit genuine documents: Ensure all submitted documents are authentic and verifiable. Never use fraudulent documents.

Consult a professional: If unsure about any part of the application, seek guidance from a regulated immigration consultant or lawyer.

2. Criminal History

A criminal record, particularly for serious crimes or recent convictions, can result in cancellation of the visa. If an individual with a visitor visa is convicted of a serious criminal offense, their visa will be canceled.

Solution:

Disclose Criminal History: Be transparent about any criminal history during the visa application process and provide evidence of rehabilitation.

Obtain Legal Advice: If you have a criminal record, consult with an immigration lawyer to understand your options.

Rehabilitation: In some cases, applying for criminal rehabilitation can help address inadmissibility issues.

3. Previous Immigration Violations

A history of immigration violations, such as overstaying a previous visit or providing false information, can lead to cancellation of the visa.

Solution:

Maintain Compliance: Always follow regulations about visa , and respect the terms of your stay.

Rectify Past Issues: If you have previous violations, consult an immigration professional to address and resolve these issues before reapplying.

Document Compliance: Keep records of your adherence to immigration laws, such as proof of departure from Canada.

4. Unclear Purpose of Visit and Lack of Return Ticket

Your visa may be canceled, and you might be denied entry to Canada if your trip does not align with:

The purpose of visit mentioned in your initial visa application

Your return ticket does not correspond with the number of days you initially requested the visa for.

Solution:

Be Consistent: Ensure that your purpose of visit remains consistent with what was stated in your initial visa application.

Return Ticket: Purchase a return ticket that matches the number of days you requested in your visa application, especially for your first visit.

5. Misleading Examples

Do not let yourself mislead from hear say examples of someone telling that someone didn’t do this or that, but still their visa is not cancelled or continues to travel to Canada. IRCC’s determination is based on several factors and varies from case-to-case basis or such a person might even got lucky that they didn’t came under the scrutiny.

However, it doesn’t mean everyone will be spared using the same loophole.

Only solution to such scenarios is never ever trust any hear says, rather stay vigilant by keeping yourself updated with latest developments in Canadian immigration and only relying on information from official IRCC website.

6. Insufficient Financial Support

Visitors must demonstrate sufficient financial resources to cover their stay in Canada. A lack of financial support can result in visacancellation. For example, if you borrow money from family or friends just to show the IRCC that you have sufficient funds and then return it after getting approval, this is not the correct approach.

Solution:

Provide Proof of Funds: Submit bank statements, employment letters, or other documents proving you have sufficient funds both when applying for the visa and upon arrival in Canada.

Maintain Financial Stability: Ensure you have enough savings to support your stay without relying on public, family, or friends’ funds.

Regular Updates: If your financial situation changes, update your financial documents and inform the immigration authorities.

7. Failure to Prove Intent to Leave

Visitors must prove their intent to leave Canada at the end of their stay, even after visa approval. A CBSA officer may ask you at the airport why you would leave Canada after your intended visit. Failure to provide a satisfactory answer can result in visa cancellation.

Solution:

Show Strong Ties: Be familiar with the information you provided in your visa application regarding your ties to your home country.

Travel History: Maintain a positive travel history by respecting visa conditions in other countries.

Supporting documents: Submit letters from employers, school enrollment documents, or proof of property ownership to demonstrate your intent to return when you initially apply for the visa.

8. Unreliable Travel History

A poor travel history, including previous overstays or refusal of visa, can affect the validity of your current visa. For example, even if you comply with Canada’s visa conditions, violations of visa rules in other countries can also lead to cancellation of visa.

Solution:

Maintain Positive Records: Ensure you comply with visa terms in all countries you visit.

Explain Previous Issues: If you have past issues, provide explanations and evidence of compliance in your subsequent travels.

Consistent Compliance: Show consistent adherence to visa regulations across all your travels.

9. Security-related Concerns

If a visitor is considered a security risk, their visa can be cancelled. For example, if a visitor visa holder becomes involved with or develops ties to a designated terrorist group, this could lead to cancellation of the visa.

Solution:

Clear Records: Ensure you have no involvement in activities that threaten national security or public safety.

Provide Clear Information: Submit all required documents, including police clearance certificates, to demonstrates that you pose no security risk.

10. Changes in Circumstances

Significant changes in a visitor's circumstances, such as losing employment or a change in family status, can lead to cancellation of the visa.

Solution:

Inform Authorities: Notify immigration authorities promptly about any significant changes in your circumstances.

Provide Documentation: Submit updated documents that reflect your new situation, such as new employment letters or changes in family status.

Be Consistent: Ensure your circumstances align with the information provided in application of your visa.

Maintaining compliance with visa regulations and being transparent throughout the visa application process is essential for anyone wishing to visit Canada. Understanding the reasons behind potential visa cancellations helps visitors avoid common issues and ensures a smooth and enjoyable stay.

By being aware of these potential challenges and taking proactive steps to address them, visitors can better protect their visa status and enjoy their time in Canada without complications.

AI has rapidly transformed the world, dominating headlines and prompting many to experiment with generative AI tools. While these technologies offer impressive capabilities, they also introduce new types of fraud. Here’s a summary of potential risks to watch out for, ensuring you stay safe online.

How Can Generative AI Be Used for Fraud?

Generative AI, with its ability to produce realistic text, images, and even mimic faces and voices, provides fraudsters with powerful tools to create convincing but misleading information. Here are some examples of how generative AI can be exploited for fraudulent activities:

Deepfake: Deepfakes use generative AI to replicate a person's appearance and voice, creating videos where individuals appear to say things they never did. Fraudsters can use deepfakes to mimic celebrities or public figures, promoting fake products or services with seemingly credible endorsements.

Enhanced Email Phishing: Generative AI can craft sophisticated phishing emails free of spelling and grammatical errors, mimicking the tone and voice of trusted individuals or organizations. This makes phishing attempts more convincing and harder to detect.

Voice Spoofing: Also known as voice cloning, this technology allows generative AI to replicate someone's voice. Fraudsters can enhance their scams by attaching voice messages to phishing emails, making them appear more legitimate if the voice belongs to a trusted person.

How Can I Protect Myself Against Generative AI Fraud?

Verify Information: Always verify emails, messages, or phone calls that seem unusual or request personal information unexpectedly. Contact the sender directly through known and verified channels to confirm the legitimacy of the request. Avoid clicking on links, downloading attachments, or calling numbers you don't recognize or trust.

Be cautious: Question investment opportunities that promise returns that are too good to be true. Before investing, ask for more information and conduct thorough research. Determine the legitimacy and motives of those promoting the offer before making any investment decisions.

Pay Attention to Details: Look out for inconsistencies such as unusual facial expressions, unnatural movements, or audio that doesn't sync with lip movements, which are signs of a deepfake.

Stay Informed: Educate yourself on how AI technologies work and keep up with the latest trends in AI fraud to better recognize potential threats.

Report Suspicious Content: Report anything unusual to the Canadian Anti-Fraud Centre online or by phone at 1-888-495-8501. Your actions could help prevent others from being deceived. If something doesn’t feel right, it probably isn’t.

By following these tips, you can reduce the risk of falling victim to generative AI fraud and help create a safer online environment for everyone.

A deportation order is a mandate for removal that imposes a lifelong ban on returning to Canada. Canada has precise laws against behaviors deemed unacceptable in Canadian society.

If an immigrant (whether temporary or permanent resident) violates these laws, the Canadian government can permanently expel them from the country. Understanding the criteria for deportation in Canada is crucial for all immigrants.

Photo by Sasan Hezarkhani on Unsplash

The following situations can cause deportation.

Engaging in a serious crime punishable by a maximum prison term of 10 years or more in Canada, such as murder or kidnapping.

Committing theft exceeding $5,000 or non-firearm robbery (armed robbery is a grave offense). Additionally, attempting to evade arrest by law enforcement.

Possessing prohibited weapons and ammunition.

Committing assault causing bodily harm, with or without the use of a firearm.

Utilizing or possessing a stolen or fake credit card.

Driving under the influence of drugs or alcohol (DUI) will lead to deportation. A DUI conviction is extremely severe. Since 2018, Canada has implemented a zero-tolerance policy for impaired or drugged drivers.

Similarly, reckless driving resulting in significant physical harm or death to another person may be grounds for deportation. For instance, driving significantly over the speed limit in a residential area and causing an accident involving a pedestrian.

Committing an "aggravated felony" is another major reason for deportation. This includes drug-related offenses such as trafficking narcotics (including 3 kg or more of marijuana), producing synthetic drugs, or growing marijuana.

Furthermore, being convicted of two or more minor offenses may lead to deportation.

Deportation can also occur for reasons related to national security, such as acts against the Canadian government.

Engaging in espionage, subversion, terrorism, or being associated with organizations involved in these activities can result in deportation.

Violations of international or human rights laws, such as war crimes, crimes against humanity (like genocide), or holding a senior position in a government that commits such crimes, may lead to deportation.

If a deported individual wishes to re-enter Canada, they must apply for an ARC (Authorization to Return to Canada) once they are deemed admissible.

Failure to leave Canada After Deportation Order

Upon the issuance of a Removal Order, you are required to leave Canada within the designated timeframe. Failure to attend a removal interview or be present on the scheduled removal date will result in the CBSA issuing a Canada-wide arrest warrant.

If you are arrested, the CBSA may detain you in a holding facility before your release.
Furthermore, the CBSA may assign an escort officer to accompany you during your departure to ensure compliance with the Removal Order.

It is also important to inform and check out with the CBSA, confirming your adherence to the order and departure from Canada.

Removal Orders Appeal

The Immigration and Refugee Board of Canada (IRB) is responsible for processing appeals related to removal orders. The IRB's Immigration Appeal Division (IAD) is tasked with hearing appeals concerning removal orders and is responsible for making legally valid decisions on immigration and refugee issues.

Among its responsibilities, the IRB determines the eligibility for refugee status among numerous applicants.

Individuals who receive a removal order typically have 30 days to appeal to the IAD. To initiate a removal order appeal, you must submit:

Notice of Appeal completed

A copy of the issued removal order

An Immigration Consultant with L3-IRB license (RCIC-IRB L3) at TTN immigration can represent you legally to appeal a deportation order or give you advice on how to overcome an entry ban.
This morning, David received a phone call, and the displayed number was from the Immigration, Refugees and Citizenship Canada (IRCC) office in Ottawa. Since I had saved this number in my contacts for work-related needs, it was indeed the correct phone number for the IRCC office in Ottawa (1-888-242 2100). However, the content was a pre-recorded message, and upon listening, it was clear that it was a scam. There was also some content in Chinese (likely targeting individuals of Chinese or Asian descent), prompting the listener to choose a number to converse in English or Chinese.

A client of mine in Manitoba also shared how they received a call from "Manitoba Hydro" informing them of a debt and threatening to cut off their electricity in the winter if not paid immediately, and they were asked to provide an email for e-transfer payment... Luckily, the client encountered difficulties with online payment and was too busy with work, so they postponed the payment to the evening. Later on, they suddenly came to the realization, "Wait, why e-transfer?!"

Therefore, David wants to write this article about Voice Phishing, or Vishing, because this wasn't the first time I had received such calls impersonating government agencies, CBSA, IRCC, banks, conducting surveys, etc...aiming to defraud, extorting sensitive personal information and assets.

If someone call and introduce themselves as being from a certain agency but using a different phone number, "experienced" individuals can easily look up the number to see if it matches the phone number published on official websites or mainstream media. However, with Vishing, it's highly possible that the phone number displayed on your phone matches the phone number of the impersonated government agency or organization.

Warning: Sophisticated Scams Impersonating Government Agencies and Organizations

In the modern age of technology, scamming methods are becoming increasingly sophisticated and complex. Particularly, scammers don't hesitate when it comes to impersonating reputable government agencies such as Immigration, Refugees and Citizenship Canada (IRCC), CBSA, CRA, or any other organization or company to deceive the public and customers. This not only results in financial losses for the victims but also poses a threat to the trust in the impersonated government agencies, organizations, companies, and the security of the community as a whole.

One of the most common tactics used by scammers is to make phone calls to victims, often using phone numbers that display the name and correct phone number of government agencies, organizations, or businesses. In doing so, they create an illusion of legitimacy, making the victim believe they are communicating with an official entity.

In many cases, these calls will attempt to persuade the victim into provide sensitive personal information or to demand payment of fines or debts into their personal accounts. Scammers may also use threats or emotional manipulation to instill fear in the victim and easily lure them into their trap.

For reputable government agencies, organizations, and companies, impersonation not only causes harm to the deceived individuals but also affects the reputation and trustworthiness of these entities. Therefore, raising awareness and vigilance is crucial.

To avoid falling into the these traps, everyone should remember that genuine government agencies never ask for payments over the phone or request sensitive personal information via unsolicited phone calls. If there are any doubts about the authenticity of a call, individuals should independently verify the contact information directly from the official website of that agency or company, or use other known means of communication to reach out to them directly.

Through understanding and vigilance, we can prevent fraud and protect the community from unnecessary losses. Let's react together and spread this message to build a safer and more trustworthy society.

Individuals who use Apple phone can read more about how you can protect sensitive information through Apple's support page.. Individuals who use Android phones can access Google's support page to know more.

Dear Facebook Team,

I hope this message finds you well. My name is Van Duy Khiem Le, and I have gone by David Le for many years, known by my family members, friends and partners. This was also IDed and verified by Facebook.

I am writing to you regarding the recent decision to permanently disable my personal Facebook account, which has been active for over 15 years (used to connect with friends and people from my original hometown) + restrict another account of ~6 years (used to connect with people in Canada when I immigrated into Canada).

I am being attacked by cyber criminals hired by the competitor. I am truly perplexed and distressed by this action, and I believe there may be a misunderstanding or an unfortunate incident that led to this decision.

It has come to my attention that my account may have been compromised by black hat hackers who have used illicit tools/bots to report or hack into my account. I have reasons to believe that these unauthorized activities and multiple false reports of my legal and free-speech content, led to what’s called violating “community standards” and the account’s permanent disabling. It happened while I was sleeping at night. I found out in the early morning when I woke up.

I understand the importance of maintaining a safe and respectful community on Facebook, and I fully support your commitment to enforcing community standards. However, I firmly believe that my account has been unfairly targeted due to malicious activities beyond my control.

I assumed they hacked and accessed my business account and initiated a report of violating Intellectual property against myself/ own business account. I realized this when I received an email confirming receipt of “my report” that I did not do. 2 Facebook’s email responses regarding this incident have been reported to Facebook.

I kindly request that you provide me with an opportunity to appeal this decision and have my account thoroughly reviewed by a person not auto response and AI/bot response with templates. I am more than willing to cooperate in any investigation and provide any necessary information to prove my innocence. I value the connections and relationships built over the years on Facebook and am eager to resolve this matter promptly.

Please consider the possibility of external interference and grant me the chance to present my case. I am confident that a thorough review will reveal the true nature of the situation and result in the reinstatement of my account.
