Chương trình thí điểm nhập cư là gì?

Các chương trình thí điểm nhập cư là những lộ trình tạm thời dẫn đến thường trú nhân. Các chương trình thí điểm thường kéo dài tối đa 5 năm trước khi hết hạn và ngừng nhận đơn đăng ký mới.

Canada triển khai các chương trình thí điểm để giải quyết tình trạng thiếu hụt lao động tại các khu vực hoặc ngành nghề cụ thể, đồng thời hỗ trợ tăng trưởng kinh tế tại một số vùng hoặc lĩnh vực nhất định.

Các công ty bảo hiểm nước ngoài nào đủ điều kiện cung cấp bảo hiểm cho Super Visa?

• Phát hành hoặc thực hiện hợp đồng bảo hiểm trong quá trình kinh doanh tại Canada (các chính sách bảo hiểm phải có tuyên bố rõ ràng về điều này).

Lưu ý: Các nhà môi giới bảo hiểm và quản trị viên khiếu nại bảo hiểm không nằm trong danh sách của OSFI.

Yêu cầu đối với tất cả các kế hoạch bảo hiểm (Canada và nước ngoài)

• Có hiệu lực tối thiểu một năm kể từ ngày nhập cảnh.
• Được thanh toán toàn bộ hoặc theo từng đợt với một khoản đặt cọc.

Khi nhập cảnh, người giữ Super Visa phải xuất trình bằng chứng thanh toán bảo hiểm với nhân viên hải quan.

Cách kiểm tra công ty bảo hiểm nước ngoài có đủ điều kiện hay không

1. Xác nhận công ty bảo hiểm có trong danh sách của OSFI bằng cách tra cứu danh sách các tổ chức tài chính do OSFI quản lý.
2. Kiểm tra xem công ty có được cấp phép theo Luật Công ty Bảo hiểm hay không bằng cách gửi email đến OSFI (information@osfi-bsif.gc.ca) với đầy đủ thông tin công ty bảo hiểm và yêu cầu cần xác minh. OSFI sẽ trả lời trong tối đa 15 ngày.
3. Đảm bảo công ty bảo hiểm thực sự phát hành hợp đồng trong quá trình hoạt động tại Canada, điều này phải được nêu rõ trong hợp đồng bảo hiểm.

Super Visa và lợi ích

Super Visa là diện cư trú tạm thời dài hạn dành cho ông bà, cha mẹ của công dân hoặc thường trú nhân Canada, cho phép họ ở lại Canada tới 5 năm mỗi lần nhập cảnh, có thể gia hạn thêm 2 năm.

Super Visa là một giải pháp thay thế cho Chương trình bảo lãnh cha mẹ và ông bà (PGP), vốn có hệ thống bốc thăm ngẫu nhiên và thời gian chờ lâu. Trong khi PGP giúp người bảo lãnh đưa cha mẹ, ông bà sang Canada với tư cách thường trú nhân (PR), Super Visa là lựa chọn nhanh chóng hơn để đoàn tụ gia đình trong thời gian dài.

Điều kiện để xin Super Visa

Người bảo lãnh (host) phải:

• Là con hoặc cháu của đương đơn.
• Là công dân Canada, thường trú nhân hoặc người bản địa đã đăng ký.
• Trên 18 tuổi.
• Đáp ứng mức thu nhập tối thiểu theo quy mô gia đình.
• Cam kết hỗ trợ tài chính cho đương đơn trong suốt thời gian lưu trú.

Người xin visa phải:

• Nộp đơn khi đang ở ngoài Canada.
• Xin visa tại văn phòng thị thực bên ngoài Canada.
• Đáp ứng yêu cầu nhập cảnh Canada.
• Khám sức khỏe định cư.
• Có bảo hiểm y tế cho toàn bộ thời gian lưu trú.

Nếu chỉ định thăm Canada dưới 6 tháng, có thể nhập cảnh theo diện visitor mà không cần Super Visa.

Bộ Di trú, Người tị nạn và Quốc tịch Canada (IRCC) đã thông báo rằng các chương trình thí điểm nhập cư mới dành cho nhân viên chăm sóc tại gia sẽ chính thức mở vào ngày 31 tháng 3 năm 2025. Các chương trình thí điểm này được IRCC gọi chung là “Home Care Worker Immigration Pilots”.

Những chương trình này sẽ thay thế các con đường xin thường trú (PR) dành cho người chăm sóc đã hết hạn trước đó. Những nhân viên chăm sóc tại gia đủ điều kiện sẽ có thể nhận được thường trú nhân ngay khi đến Canada thông qua các chương trình thí điểm mới này.

Ai đủ điều kiện tham gia chương trình này?

Để đủ điều kiện tham gia các chương trình thí điểm nâng cấp dành cho nhân viên chăm sóc tại gia, công dân nước ngoài phải:

• Có khả năng sử dụng ngôn ngữ chính thức tương đương với cấp độ 4 dựa trên hệ thống Canadian Language Benchmark (CLB);
• Có bằng tốt nghiệp trung học phổ thông của Canada hoặc tương đương;
• Có kinh nghiệm làm việc gần đây và liên quan*;
• Nhận được lời mời làm việc toàn thời gian trong lĩnh vực chăm sóc tại gia.

*Từ ngày 16 tháng 6 năm 2024, các ứng viên tham gia các chương trình nhập cư trước đó dành cho nhân viên chăm sóc tại gia chỉ cần 6 tháng kinh nghiệm làm việc hợp lệ để đủ điều kiện xin thường trú.

IRCC vẫn chưa công bố thêm các chi tiết và yêu cầu cụ thể khác.

Bối cảnh

IRCC lần đầu tiên thông báo ý định mở các chương trình thí điểm nhập cư mới cho nhân viên chăm sóc tại gia vào ngày 3 tháng 6 năm 2024. Khi đó, chỉ một số tiêu chí cơ bản được công bố.

Không lâu sau đó, vào ngày 17 tháng 6 năm 2024, bộ di trú đã đóng cửa chương trình Home Child Care Provider Pilot và Home Support Worker Pilot. Các chương trình thí điểm mới sẽ thay thế các con đường nhập cư dành cho người chăm sóc trước đó.

Việc đóng cửa các chương trình Home Child Care Provider Pilot và Home Support Worker Pilot cũng đánh dấu sự tạm ngừng các chương trình thí điểm nhập cư chuyên biệt cho người chăm sóc. Trước đây, các con đường nhập cư dành cho người chăm sóc bao gồm:

• Chương trình Live-in Caregiver (đóng cửa năm 2014);
• Chương trình Caring for Children Pilot (đóng cửa năm 2019);
• Chương trình Caring for People with High Medical Needs Pilot (đóng cửa năm 2019);
• Chương trình Interim Pathway For Caregivers (đóng cửa năm 2019); và
• Home Child Care Provider Pilot và Home Support Worker Pilot (đóng cửa năm 2024).

Hiện tại, số suất phân bổ cụ thể cho chương trình này vẫn chưa được công bố, nhưng IRCC sẽ phải chia các suất nhập cư mới này cho:

• Các chương trình thí điểm mới dành cho nhân viên chăm sóc;
• Chương trình Agri-Food Pilot;
• Các chương trình thí điểm nhập cư cộng đồng; và
• Chương trình Economic Mobility Pathways Pilot.

Ngoài ra, tìm hiểu và tận dụng các chương trình định cư tỉnh bang cũng giúp người nhập cư chọn được con đường phù hợp nhất. Đồng thời, kết nối với cộng đồng và tham gia các tổ chức hỗ trợ người nhập cư là cách hiệu quả để hội nhập nhanh chóng và tìm kiếm cơ hội nghề nghiệp.

From today onwards, most study permit applications will now require a Provincial Attestation Letter (PAL) or a Territorial Attestation Letter (TAL). Here’s what you should know:

Who Needs a PAL/TAL?

Unless you qualify for an exemption, you must include a PAL/TAL:

• With your application—submitting it later is not allowed.
• Even if you’re applying for a prerequisite course, such as language programs.
• For each applicant, even if applying as a family or group.

Important Information:

PALs and TALs are valid only for the study permit cap year in which they are issued:

• 2024 Cap Year: Valid from January 22, 2024, to January 21, 2025.
• 2025 Cap Year: Valid from January 22, 2025, to December 31, 2025.

If your application was:

• Not processed: You can reuse the same PAL/TAL if it remains valid.
• Refused or if you’re transferring to a new school: You’ll need a new PAL/TAL to reapply.

Who Doesn’t Need a PAL/TAL?

You are exempt if:

• You are enrolled in preschool, primary, or secondary school, including kindergarten.
• You’re accepted to a federally designated military college or a Francophone Minority Communities Student Pilot (FMCSP) school with a valid acceptance letter.
• You are pursuing a vocational program in Quebec leading to a DVS, AVS, or STC.
• You’re an exchange student with tuition covered by your home institution.
• You’ve received a Global Affairs Canada scholarship.
• You qualify under public policy for migration crises or Indigenous family reunification.
• You are applying to extend your study permit at the same DLI and academic level.
• You are a protected person, refugee, or eligible for permanent residence under specific conditions.

Note: If you are exempt, include proof with your application instead of a PAL/TAL.

How to Obtain a PAL/TAL:

For institutions outside Quebec: Contact your school to request a PAL/TAL.

For institutions in Quebec: Follow the provincial procedures to obtain the required documents.

Recently, Canada's immigration policies have evolved to better align with labour market needs. Coupled with a highly competitive pool of candidates, transitioning from a study permit to permanent residency can be more challenging.

For international students aiming to make Canada their home, here are some tips to maximize their points and improve their chances successfully obtaining permanent residence.

Stay up to date with changing immigration policy

Immigration policies in Canada can shift in response to the country's economic needs. For international students aiming for permanent residency in the future, staying updated on eligibility criteria for various programs is crucial.

For instance, earlier this year, the Canadian government announced a change affecting international students. Those enrolled in study programs under curriculum licensing agreements will no longer qualify for a Post-Graduate Work Permit (PGWP) upon graduation

These programs are offered by private colleges with licenses to deliver the curriculum of associated public colleges, and they often face less oversight compared to programs at public institutions.

Students who plan to gain work experience in Canada through a PGWP should carefully research which study programs are eligible for this permit upon graduation.

2. Choose in-demand professions

In 2023, Canada introduced category-specific Express Entry draws to target occupations and skills that are in high demand. These categories include:

• Healthcare
• Science, Technology, Engineering, and Mathematics (STEM)
• Trade
• Transport
• Agriculture and Agri-food

Students who are still exploring their career options might consider pursuing qualifications in these high-demand fields to enhance their chances in Express Entrydraws. For instance, careers in STEM fields like architecture, engineering, data science, or web development could improve their prospects.

However, it's important to note that these categories can change and do not guarantee permanent residence.

3. Research Provincial Nominee Programs

Every province and territory in Canada, except Quebec and Nunavut, runs Provincial Nominee Programs (PNPs) to attract skilled workers. If an international student finds their Comprehensive Ranking System (CRS) score insufficient or doesn't qualify for a category-based draw, they might consider exploring provincial nominations.

There are two main pathways for immigrating through a PNP:

Express Entry: This route involves applying through Express Entry, where provinces can award an additional 600 CRS points to eligible candidates, boosting their chances of obtaining permanent residency (PR) through Express Entry.

PNPs: This route involves applying directly through a provincial PNP stream, bypassing Express Entry.

With over 80 different provincial economic streams available, students have a wide range of opportunities to explore for gaining permanent residency through their education and employment in Canada. However, it's important to note that PNP criteria can change based on each province's economic priorities.

4. Improve both language abilities

Canada's two official languages—English and French—offer significant advantages in the process of permanent residence (PR). International students can boost their Comprehensive Ranking System (CRS) score by excelling in their primary language and retaking language tests like IELTS or CELPIP if needed to achieve a higher score.

Additionally, learning French can further enhance a candidate's CRS score and increase their chances of receiving an Invitation to Apply (ITA). In 2024, Canada introduced French language proficiency Express Entry draws and this trend is anticipated to continue into 2025 and 2026. To be eligible for these draws, candidates must achieve a minimum score of 7 in all four language abilities (reading, writing, speaking, and listening) on the Niveaux de compétence linguistique canadien (NCLC).

Validate all degrees

Canada's Express Entry system values education and awards points based on your academic qualifications. For international students with multiple degrees obtained outside Canada, validating these credentials through designated organizations approved by the Canadian government, such as WES, can be beneficial.

Additionally, pursuing an eligible degree or program within Canada can further enhance your prospects. Studying in Canada not only provides valuable education but also improves your chances in Express Entry, making you a more competitive candidate for permanent residency.

What are LMIAs and CAQs?

LMIAs and CAQs are essential documents that confirm a foreign worker’s eligibility to work in Canada, typically submitted alongside an application for work permit.

An LMIA (Labour Market Impact Assessment) is a requirement for Canadian employers under the federal Temporary Foreign Worker Program (TFWP)). Employers must submit this application to Employment and Social Development Canada (ESDC) to demonstrate that hiring a foreign worker will have a positive or neutral effect on the Canadian labour market.

The CAQ (Quebec Acceptance Certificate), on the other hand, is issued by the Government of Quebec to foreign workers and international students who meet the province's admission criteria, allowing them to obtain a work or study permit. Quebec-based employers hiring foreign workers must secure both an LMIA and a CAQ for their workers.

How to Extend Your Work Permit Without a New LMIA or CAQ

According to Immigration, Refugees and Citizenship Canada (IRCC), you can apply to extend your work permit if it is set to expire within two weeks of your extension application. However, IRCC requires that you submit proof of a valid job offer along with evidence that you have already applied for a new Labour Market Impact Assessment (LMIA) and, if required, a Quebec Acceptance Certificate (CAQ).

There are several ways to prove that you have submitted your LMIA and CAQ applications when applying extension for your work permit:

1. Upload a copy of the LMIA and CAQ (if applicable) application submissions.
2. Upload a copy of the receipt or confirmation number (for online applicants) for both the LMIA and CAQ, if applicable.
3. In the “Details of Intended Work in Canada” section of your application, provide the following information:
   • The date the LMIA/CAQ request was submitted
   • The office where it was sent
   • The employer’s name
   • The confirmation number for the submission (if available)

*For Quebec work permit extensions submitted online, you will be asked to upload a copy of your CAQ. If your new CAQ is not available yet, you can submit your CAQ receipt confirmation number or a copy of your CAQ application instead.

What Should I Do After Receiving My New LMIA and CAQ (If Applicable)?

Within 60 days of when IRCC receives your new work permit application, you must submit proof of your new LMIA and, if applicable, your CAQ to the responsible immigration department.

Failure to provide this proof within the required timeframe could result in your work permit application being denied.
